USA Video Technology Sues Cable Companies for Patent Infringement

OLD LYME/LOS ANGELES, June 16: The Connecticut-based USA
Video Technology Corp. (USVO) has filed a patent infringement suit against Time
Warner Cable and Comcast Cable, among other platforms, over their VOD services.
Meanwhile, a federal appeals court has upheld a ruling in favor of the
broadband service Movielink in a similar suit brought by USVO.

USVO designs and markets technology for the delivery of
digital media. It says it holds the patent for “store-and-forward video,” issued
by the United States Patent and Trademark Office in 1992. It says it holds
similar patents in Germany, Canada, England, France, Spain, Italy and Japan.
USVO yesterday filed suit in a Texas court against Time Warner Cable, Cox
Communications, Charter Communications and Comcast Cable, alleging that they
infringed upon that patent in rolling out their video on demand services. USVO
is seeking “fair compensation and a court injunction against further
infringement.”

Meanwhile, the United States Court of Appeals for the
Federal Circuit has affirmed the district court's judgment of non-infringement
for Movielink. The Federal Circuit Court upheld the decision originally made in
January 2005 by Federal District Court Judge Kent A. Jordan that Movielink's
online movie distribution service did not infringe on USA Video's patent, a
claim originally filed against Movielink in April 2003.
